This document (“Terms”) contains the Terms of Use of the website www.generation.bg (“Site”). Please read them carefully. By using the site, you agree to these Terms.

In connection with the Services provided, GENERATION EOOD (Generation) processes personal data in accordance with the Personal Data Protection Policy (“Policy”), which is an integral part of these Terms.

By submitting an ad on the Site, you agree to the Terms and Conditions for posting ads, part of the Terms.

1. General provisions

1.1. GENERATION EOOD with management address Sofia, Triaditsa district, 164 VITOSHA BUL., 2nd floor, mag. 7 , EIK: 201676688 provides customers (“Customers”, “Users”), through the Generation.bg website, information services (“Services”), related to the search and supply of real estate (“Offers”) and carrying out transactions with real estate properties.

1.2. In order to use the Services, You warrant that You are at least 18 years of age and have legal capacity to enter into a contract under the Terms set forth herein.

1.3. The site provides an information array with electronic records (“offers to offer” and “requests for searches” of real estate), corporate information, own and foreign materials in the form of articles and news, statistical and geographical information from external sources, own statistical information for average property prices in Bulgaria, images, graphic images, other materials related to the subject of Generation’s activity.

1.4. Real estate offers and search requests are collected, processed and entered into a database by Generation’s real estate agents, consultants and administrators, as well as by third party Users, through the private listing submission forms provided.

1.5. The information comes from Generation’s Clients on the occasion of Generation’s professional brokerage activity in real estate transactions.

2. Responsibilities

2.1. We (Generation) strive to maintain the most accurate and up-to-date information on the Site, but due to the dynamics and variety of information offered, as well as the fact that the information is often provided by third parties at their own risk, the users of the Site agree that this (maintaining the most accurate and up-to-date information) is not always possible. Therefore, Generation assumes no responsibility for the accuracy and completeness of the information and the Services, and reserves the right to provide the user with corrected information upon specific request.

2.2. You (as a User) undertake to provide correct data when using the services, in connection with filling out the contact forms on the Site. In case of inaccuracy in the data, you have no right to use the Services until it is corrected.

2.3. By filling out any of the contact forms on the site, by pressing the SEND button, you agree to the Terms, expressly giving your consent to contact you on the indicated phone number, as well as to receive electronic communications from Generation in the form of e-mail and SMS. In every e-mail sent to you, you have the option to opt out of receiving e-mail communications. If you do not wish to receive SMS messages on your phone, you must request this by calling 0893 454 665 on weekdays between 09.00 and 18.00.

2.4. Real estate prices published on the site are often subject to change and do not constitute a binding offer for a real estate transaction.

2.5. The site provides the opportunity to publish real estate search and offer ads. Ads and their content must comply with the Advertising Terms.

2.6. Generation assumes no responsibility for any losses, damages, damages, adverse consequences and lost profits in connection with the use of the site.

2.7. You may not use in any way, copy, modify or distribute content that does not belong to You for purposes different from or incompatible with the use of the Services and the purpose of the Site without the express prior written consent of Generation and /or to the relevant third parties.

3. Right to Changes

3.1. Generation reserves the right to add new Services, functionalities and terms of use to the Site, to change or remove existing ones, without the need for prior warning or user consent.

3.2. These Terms may be changed in connection with the development, addition of new, modification or termination of existing Services or in the event of legislative changes. When changes are made, they will be brought to your attention and posted here.

3.3. Because the Services may only be used in accordance with these Terms, if you do not agree with them, you should not use the Site.

4. Ownership

4.1. All information from the Generation database, including offers for sale and real estate search requests, (including text content, images, graphics, photos, files, etc.) is the property of GENERATION EOOD.

4.2. The disposal of the property rights takes place with the express written consent of Generation.

4.3. When publishing third-party content, we make every effort to clarify intellectual property rights to photos, texts, graphics and functionality. We apologize if we have not been able to identify and contact the author of any material we have used in advance.

4.4. In the case of content copyright claims, the applicant is required to notify Generation, specifying the subject of copyright and providing documentation of ownership of the subject. Upon a request to remove copyrighted content made under the terms of the preceding sentence, Generation will comply with the author’s request.

5. Links to Other Sites

5.1. Generation makes it possible for all interested parties to link to the Generation Sites without asking for prior notice or permission.
Generation may require the termination of an established link if it uses a technique to recreate a certain part of the Generation sites as the own of the persons using the link, without obtaining prior consent from Generation.

6. Order for a real estate inspection through the website

6.1. From the “VIEWS” button to any offer for sale or rent of real estate offered by Generation, you can place an order for a viewing by filling out the contact form. Before submitting the order for viewing, You must agree to the Terms and Policy. By pressing the “Send” button and confirming the e-mail you received, you make an electronic statement, with which you commit Generation to organize an inspection of the property specified by you. You accept that electronic statements to Generation and electronic statements from Generation to you will be considered signed with an electronic signature in accordance with Art. 3, paragraph 10 of Regulation (EU) No. 910/2014, with the force of a manual signature. The authorship of these statements will be established in accordance with Art. 13, para. 1 in connection with Art. 13, para. 4, of the Law on Electronic Documents and Electronic Authentication Services (ELSA).

6.2. According to Art. 5 of ZEDEUU You agree to receive electronic statements from Generation, in electronic form.

PRIVACY POLICY

Please read this document carefully. It contains the Policy for the protection of the personal data of the Users of the Site (“Policy”) and is an integral part of the Terms of Use of the Site. If you do not agree with the Policy, you may not use the Site.

GENERATION EOOD with management address: 164 VITOSHA Blvd., 2nd floor, mag. 7, EIK 201676688, (Generation) as a Real Estate Broker, carrying out a commercial activity by occupation, namely mediation in real estate transactions, requires, stores and processes personal data of Customers wishing to use Services from Generation and users of The Site (Users/Data Subjects) for the purposes of serving them.
In the event that you do not wish to provide your personal data, you express disagreement with our Policy, which means that you cannot use the Generation Services.

In order to provide the Services on the website www.generation.bg, Generation stores and processes data of Users, as well as the results of this processing, in accordance with this Policy.

1. Persons for whom Generation stores and processes data

1.1. In connection with the Services provided, Generation processes information regarding the following Data Subjects:
a/ Users – users of the Site; b/ Users – who have sent inquiries (by calling the phone or using one of the contact forms on the site); c/ Users who have sent correspondence to Generation; d/ Customers wishing to use Services from Generation.

2. Information that you provide to us as a User

2.1. You can use the Services provided through the Site by using the contact forms with Generation, where we clearly indicate the mandatory fields for providing personal data, without which it is impossible to provide our Services – these are name, phone number, email address .

2.2. Generation stores and processes information about personal data received through the contact forms on the Site, by phone calls or by sending correspondence by e-mail.

2.4. Generation stores and processes the User’s email address information received through the subscription form on the Site, where the User (Data Subject) has the opportunity to subscribe to receive email notifications (Notification) about new or updated listings (real estate offers). , according to selected search criteria.
The user can cancel his subscription by pressing the cancel button, which is available in every email received or by calling tel. 0893 454 665 every working day from 09:00 to 18:00.

2.5. The Site allows the User to save selected listings (offers for sale and real estate search requests) that can be easily viewed at a later time from the Notebook page. The notebook is personal to the User. In it, you can add or delete added ads at any time.
In connection with this functionality of the Site, Generation stores information on so-called cookies.

2.6. The site saves information about the User’s previous searches, as well as about ads already viewed. In these cases, Generation uses “cookies” to show you quick links to repeat searches already made and offers viewed.

3. Purposes for which we process personal data

3.1. Generation collects, uses and processes the information described above for the Purpose:

a/ provision of the information sought by the User about real estate and related information services;
b/ conclusion of contracts for intermediary services, namely:

• Brokerage contract for the sale of real estate,
• Brokerage contract for the purchase of real estate,
• Brokerage contract for the rental of real estate,
• Real estate brokerage agreement.

c/ conducting inspections of real estate and providing information on real estate, the formation of, as follows:

• Order – Protocol for inspection of real estate;
• Protocol for the provision of information.

d/ for accepting and processing received offers, signals, complaints, requests and other correspondence;
e/ to fulfill legal obligations related to requirements for storing or providing information in connection with an order from competent state or judicial authorities.

4. The information we process and store

4.1. On the occasion of the implementation of its main subject of activity, Generation collects and processes information related to the search and supply of real estate, and for these purposes the agents and administrators of Generation enter into the corporate database information submitted by Users, as follows:

a/ when searching for a property: name, phone, e-mail, budget (approximate price of the transaction), characteristics of the searched property;

b/ when offering a property: name, telephone, e-mail of the owner, address of the property, selling price or monthly rent, main characteristics of the property, according to the corporate requirements for entering specific information into the database;

c/ when concluding Mediation Agreements: name, telephone, e-mail, permanent address, ID number, TIN;

d/ for conducting real estate inspections and providing real estate information: name, phone, e-mail, permanent address, ID number, social security number;

e/ for documenting contractual relations, (by concluding Preliminary Agreements for the purchase and sale of real estate under Article 19 of the Commercial Code, Lease Agreements, Guarantee Agreements, Deposit Agreements, Agreements, various types of Annexes and other commercial documents activity of Generation): name, phone, e-mail, permanent address, ID number, social security number;

f/ when considering job applications: names of applicants, phone, contact e-mail, biographical data;

g/ for personnel and accounting purposes: name, telephone, e-mail, permanent address, identity card number, social security number;

4.2. Generation does not collect or store sensitive personal data from the special category within the meaning of Art. 5 of the Personal Data Protection Act, namely those that:

a/ reveal racial or ethnic origin;
b/ reveal political, religious or philosophical beliefs, membership in political parties or organizations, associations with religious, philosophical, political or trade union goals; c/ refer to health, sexual life or the human genome.

5. Security

5.1. Generation works to protect the privacy and security of the information it receives in the course of its business. Access to this information is restricted and policies and procedures are in place designed to protect the information from loss, misuse and improper disclosure.

6. Use of Collected Information

6.1. Generation uses the provided information only for the purpose of carrying out its activity and for the purpose of carrying out the real estate transactions desired by users and customers and carrying out its activity.

7. Information and personal data storage terms

7.1. Registration data (such as first name, last name, email address) and IP address – are stored indefinitely, until they are deleted by you

7.2. Subscriptions to receive ads with selected criteria – for the period for which the subscription is active, until its termination. Subscription can be terminated at any time.

7.3. Quick searches and last viewed offers – until they are deleted by you

7.4. “Cookies” – until they are deleted by you or up to 6 months after the last use of the Site

7.5. System logs (may contain information such as: date and time, IP address, URL, browser and device version information) – for a period of up to 1 year.

7.6. Copies of the database (Backup) – up to 30 days.

7.7. Correspondence, complaints and signals, requests, incl. by e-mail – for a period of up to 5 years.

7.8. Records of incoming phone calls through the Generation contact center – up to 3 months.

7.9. Resumes and related documents of candidates for jobs at Generation – up to 1 month from their submission;

7.10. Activity contracts, including mediation contracts – up to 5 years.

7.11. The specified terms can be changed, according to the requirements of the current legislation.

7.12. When resolving disputes and conducting court cases, it is possible to save data for longer than the specified terms – until the final conclusion of the dispute and court proceedings.

8. Mode of providing information

8.1. Generation does not provide, on any occasion, to third parties, information representing personal data of users, except with their express consent and in the cases provided by law.

8.2. In order to carry out the desired transactions with real estate by the Users who have submitted offers for the offer of real estate, Generation has the right to provide to third parties a descriptive description of these properties, prepared according to the rules of corporate practice of Generation and published in the public part of The site.

9. Your rights in relation to the personal data you have provided to Generation

9.1. Users have a legal right to request details of the personal information we hold about them. Generation enables you to keep your personal information accurate and up-to-date. At any time, you can ask Generation to correct, delete or restrict the processing of your personal data. You can request confirmation of whether your personal data is being processed by Generation, as well as access to correct your personal data, exercise your right to data portability or withdraw your consent to the storage and processing of your personal data.

9.2. In the above cases, you must make a request through the main contact form on the Site.

9.3. Upon deletion of personal data provided in connection with offers processed by Generation and real estate search requests, the number of the relevant offer/request and its content, as well as information about the date of deletion of your personal data, will remain in our database data.

9.4. Upon receipt of a request to delete personal data or an objection to its storage and processing by Generation, we will consider your request and, if justified, comply with it. If we believe that there are compelling legal grounds for storing and processing your personal data, or that these actions are necessary to protect our rights, we will inform you of this.

10. Information about logs, cookies and Internet beacons

10.1. The Site collects standard Internet log information, including your IP address, browser type and language, access time, and referring website addresses. To ensure that the Site is well maintained and to ensure better navigation, we or our service providers may use cookies (small text files stored in the user’s browser) or Internet beacons ( web beacons) (electronic images that allow the Website to count visitors to a particular page and to access certain “cookies”) to collect aggregate data.

10.2. We do not collect and store individual (non-aggregated) cookies.

11. Social Media and Platforms

11.1. You may wish to participate in various blogs, forums and other social media platforms offered by Generation or provided to you. Any personal data or other information you share on the Social Media Platforms may be read, collected and used by other users of the Social Media Platforms over which we have only partial or no control. Therefore, we are not responsible for the use, misuse or misappropriation by other users of any personal data or other information that you share on the Social Media Platforms.

11.2. A link to a third-party website should not be construed as an endorsement by Generation of the level of personal data protection on the third-party platform. Generation makes no representations or warranties about how user data is stored or used on third-party servers. We recommend that you review the privacy statement of each third-party site linked to our site to determine how they use your personal information.

12. Protection of children’s privacy

12.1. This website is not intended for children. We understand the importance of protecting children’s information, especially in the online environment, and we do not have a policy of knowingly collecting or maintaining information about persons under the age of 18.

13. Continuity of actions related to confidentiality and protection of personal data

13.1. Generation undertakes to observe and implement measures for confidentiality and security of information continuously, as part of its activity.

13.2. If necessary, Generation may change the Privacy Policy. If changes are made to this statement, please note that it may take up to 30 days for new privacy practices to be implemented. TERMS OF PUBLICATION OF ADS

1. Every User has the opportunity to submit real estate search and offer ads on the Site free of charge, according to the conditions specified here.
2. Users can choose whether to submit an Ad to Generation or post a Private Ad.
3. Each User, identified by name and/or IP address, and/or phone number and/or email, has the right to submit up to three private ads without registering on the site.
4. After submitting a Private ad, the User receives a unique code at the e-mail specified by him, with which he can edit and delete a published ad.
5. The user who submitted a private ad also gives his consent to the content of the ad being advertised by Generation and to be provided to third parties, real estate agents, real estate brokers or end customers, in order to realize the desired real estate transaction by the advertiser. Generation does not provide third parties with users’ personal data, only the content of the ads, incl. submitted photo material.
6. The user, who has submitted an Advertisement to Generation, is considered to be informed and agree that by pressing the “Send” button and confirming the email received, he makes an electronic statement, with which he commits Generation to conclude a contract, by virtue of which Generation, as real estate broker, has the right to remuneration for the realization of a real estate transaction.
7. Despite the mandatory verification of published information, Generation cannot be protected from incorrect or malicious actions by Users. In this sense, responsibility for the topicality, accuracy of the content and qualities of the submitted information, incl. and for copyrights on photographs and other content items, the advertiser, identified by name and/or contact phone, email, IP address, bears.
8. Generation has the right not to publish or to remove an already published advertisement at any time and when:
   a/ it considers that the content of the advertisement (including text and/or photos) is misleading for the user or does not correspond to the property actually offered , or has no aesthetic value; b/ the ad contains advertising of goods and services or links to external websites, or obscene texts, insults and qualifications; c/ the submitted photo material is of poor quality, (small photo size, unclear focus, etc.) ; d/ the text of the ad or the sender’s name are in Latin; e/ the user publishes a private ad in his capacity as a real estate agent or broker or for other commercial purposes, without registering on the site; f/ the user submits a duplicate ad (ad/ an offer that has already been published); g/ the ad contains a phone number with added value, without this being specifically and clearly stated. h/ Generation has the right to block the possibility of submitting or publishing ads by users who do not agree form with the above requirements.
9. Generation administrators have the right to edit the content of submitted ads for correct spelling and style.
10. Generation is not responsible to users and third parties for damages suffered and lost profits that occurred as a result of not publishing or removing ads, or blocking users and user accounts.
11. Generation is not responsible for the publication of advertisements that violate the Law or legitimate interests of third parties, incl. copyright or other intellectual property rights.
